Do you even owe tax on eBay sales?

It depends on what you're selling. Clearing out your own used stuff for less than you paid — no tax. Selling your old console for $200 that cost you $500 is a personal loss the IRS doesn't tax (and you can't deduct it either). But if you're buying to resell, flipping, or making items to sell, you're running a business: profit is subject to 15.3% self-employment tax plus income tax, whether or not you receive a tax form.

On reporting: the 1099-K threshold went back up to $20,000 and 200 transactions after the 2025 tax law reversed the planned $600 rule — so many casual sellers won't get a form. That changes paperwork, not the law: business profit is taxable from the first dollar.

Deductions that shrink an eBay seller's bill

You're taxed on profit, not the number on your 1099-K. Deduct: the cost of goods sold (what you paid for inventory), eBay final-value and listing fees, payment processing, shipping labels and packaging, sourcing mileage (72.5¢/mile Jan–Jun 2026, 76¢/mile after), storage costs, a qualifying home office, photography gear, and listing software. eBay's 1099-K reports the gross including shipping you charged buyers — miss your deductions and you'll overpay dramatically.

Do I pay tax on selling my own used items?

Not if you sell them for less than you originally paid — that's a non-deductible personal loss, not income. Selling a personal item for more than you paid creates a taxable gain.

Is my eBay selling a hobby or a business?

Regular activity, profit motive, and buying-to-resell point to a business (Schedule C, deductions allowed). Hobby income is still taxable but hobby expenses aren't deductible — usually the worse deal.

Does eBay collect sales tax for me?

Yes — eBay collects and remits state sales tax on your sales automatically under marketplace-facilitator laws. Income tax on your profit remains your responsibility.
